Terms of Service

PREAMBLE

PLEASE READ THESE TERMS CAREFULLY. They include provisions that materially affect your legal rights, including an assignment of intellectual property in everything you produce on the Platform (Section 8), confidentiality obligations (Section 9), a disclaimer of any employment relationship (Section 6), limitations of liability and indemnities (Sections 17 & 18), and our right to withhold or forfeit Rewards in defined circumstances (Sections 11 & 12).

By creating an account, clicking to accept, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. DEFINITIONS AND INTERPRETATION

1.1 Definitions:

Account means the personal account registered by a Contributor.

Platform means all Five Bucks websites, mobile apps, web apps, APIs, and related services.

Task means a unit of work made available through the Platform, including statement truth/falsity verification, model output evaluation, and human feedback activities.

Task Output means every response, label, rating, annotation, correction, written explanation, or work product created or submitted in performing a Task.

Reward means value credited to your Wallet for approved Tasks, Certifications, referrals, or bonuses.

Wallet means the ledger record within your Account showing credited Rewards.

Quality Score means the metric reflecting measured accuracy, consistency, peer agreement, and instruction adherence.

Gold Standard Item means a Task with a known correct response inserted into your queue without notice for accuracy measurement.

1.2 Incorporated documents: Privacy Policy, Cookie Policy, Community Guidelines, Rewards and Payout Schedule, and Referral Program Terms are incorporated by reference into these Terms.

2. ELIGIBILITY

2.1 Minimum requirements: You must be at least 18 years old (or the age of majority in your jurisdiction), have legal capacity to contract, not reside in a Prohibited Territory (subject to comprehensive international sanctions), and not appear on sanctions lists.

2.2 One Account per person: You may hold ONE Account only. Accounts are strictly personal and may not be sold, rented, shared, or transferred. Operating multiple accounts is a material breach resulting in immediate termination and balance forfeiture.

2.3 Verification: We may at any time require identity, age, residency, or tax verification. Accounts may be suspended pending verification completion.

3. ACCOUNT SECURITY

You are responsible for maintaining credential confidentiality and all activity under your Account. You must notify us immediately at security@fivebucks.com upon becoming aware of any unauthorized access or security breach.

4. THE PLATFORM AND TASK ALLOCATION

4.1 Nature of Platform: The Platform is a workflow system connecting Contributors with AI evaluation Tasks. We do not guarantee Task availability at any time or in any volume.

4.2 No commitment: You are under no obligation to accept Tasks, and we are under no obligation to offer Tasks. Allocation depends on Client demand, Quality Score, language, and geography.

5. CERTIFICATIONS

Certifications measure competence in defined domains. Certifications are internal platform credentials only and do not constitute formal professional or academic qualifications. You must complete assessments personally without unpermitted machine assistance.

6. RELATIONSHIP OF THE PARTIES

6.1 Independent Contractor: You perform Tasks strictly as an independent contractor. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship.

6.2 Control & Equipment: You determine when, where, and how long you work. You provide your own device and internet connection. You are free to work for other platforms.

7. YOUR OBLIGATIONS WHEN PERFORMING TASKS

7.1 Standard of performance: Perform each Task personally, honestly, carefully, and in accordance with published rubrics.

7.2 Prohibition on machine assistance: EXCEPT WHERE EXPRESSLY PERMITTED IN WRITING, YOU MUST NOT USE ANY LARGE LANGUAGE MODEL, CHATBOT, GENERATIVE AI, AUTOMATED TRANSLATION, OR SCRIPT TO GENERATE OR INFLUENCE TASK OUTPUT. The commercial value of Task Output relies on genuine human judgment.

7.3 Content standards: You must not submit material depicting child exploitation, unlawful discrimination, dangerous weapon instructions, copyright infringement, or personal data of third parties.

8. INTELLECTUAL PROPERTY

8.1 Assignment of Task Output: With effect from creation, you irrevocably assign to Five Bucks all right, title, and interest worldwide in and to all Task Output, including copyright and database rights.

8.2 Permitted use: Task Output may be reproduced, modified, combined, published, licensed, and sold to train, evaluate, and fine-tune machine learning models without attribution or further payment.

8.3 Our IP: The Platform, software, logos, and design are owned by Five Bucks. We grant you a limited, revocable license to access the Platform solely to perform Tasks.

9. CONFIDENTIALITY

All Client materials, Task instructions, rubrics, model outputs, and unreleased evaluation data are strictly confidential. You must not disclose, screenshot, stream, or post confidential information on social media, Reddit, Discord, or third-party AI tools.

10. DATA PROTECTION AND PRIVACY

Our processing of your personal data is detailed in our Privacy Policy. Automated processing may support quality scoring and fraud flags; you have the right to request human review of decisions that materially affect you.

11. REWARDS AND THE WALLET

11.1 Accrual & Review: Rewards accrue upon Task approval. Approval may follow a validation review period against Gold Standard Items and peer consensus.

11.2 Wallet Ledger: The Wallet is an internal ledger of owed rewards, not a bank account. Balances bear no interest and are non-transferable.

11.3 Taxes: You are solely responsible for reporting and paying taxes arising from Rewards. We may collect tax documentation (W-9 / W-8BEN) and report earnings where required by law.

12. PAYOUTS, WITHHOLDING, AND FORFEITURE

12.1 Payout requests: Payouts may be requested once the minimum threshold displayed in the app is met and email verification is complete.

12.2 Holds & Forfeiture: Payouts may be held or forfeited for multi-accounting, AI automation, fraud, or material breach of Terms.

13. INVESTIGATIONS AND APPEALS

We may suspend access while investigating suspected breaches. You may appeal adverse decisions to appeals@fivebucks.com within 30 days for human review.

14. PROHIBITED CONDUCT

Prohibited activities include botting, VPN location falsification, multi-accounting, selling accounts, colluding on answers, spamming referrals, and reverse-engineering the platform.

15. SUSPENSION AND TERMINATION

You may close your Account at any time in Settings. We may terminate accounts immediately for cause (breach of terms) or on 30 days notice for convenience.

16. DISCLAIMERS & LIMITATION OF LIABILITY

The Platform is provided "as is". Earnings are not guaranteed. To the maximum extent permitted by law, Five Bucks is not liable for indirect or consequential losses.

17. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by applicable law. Disputes should first be submitted to legal@fivebucks.com for informal resolution prior to formal proceedings.

SUMMARY OF KEY TERMS

1. Must be 18+ with one account per person.

2. All Task Output belongs to Five Bucks to train AI models.

3. Never use ChatGPT or AI tools to answer Tasks.

4. Never leak or post Task content on Reddit/Discord.

5. Independent contractor relationship no employment benefits.

6. You can request payouts once reaching minimum thresholds.
